Terms of Service

These Terms govern the use of the Cool platform. By creating an account or using the service, you agree to them. Please read carefully.

This text is a standard template provided by the Cool platform to help communities and creators get started. It reflects the spirit of Brazil's LGPD (Law No. 13,709/2018) and the GDPR (EU Regulation 2016/679), but it does NOT constitute legal advice. Before publishing, review it with a qualified lawyer to tailor it to your business, country and way of operating.

Acceptance of terms

By accessing or using Cool, you represent that you have read, understood and agree to these Terms and the Privacy Policy. If you do not agree, do not use the platform. If you use the service on behalf of an organization, you represent that you have authority to bind it.

Description of the service

Cool is a platform that lets creators build paid communities with a feed, courses, live streams, gamification, events and payments (including Pix). We may add, change or remove features at any time to improve the service.

Accounts

You are responsible for keeping your password confidential and for all activity on your account. Provide truthful information and keep it up to date. You must meet the minimum legal age to use the service. Notify us immediately of any unauthorized use.

Community owners and members

Cool has two main roles: the community owner (who creates and runs the community, sets prices, posts content and moderates) and the member (who takes part, consumes content and interacts). The owner is directly responsible for their community's content, prices and rules; Cool provides the technology. Each community may set its own additional rules, as long as they do not conflict with these Terms and the Code of Conduct.

Payments, subscriptions and refunds

Communities may be free or paid (one-time charge or recurring subscription). Payments are handled by payment partners; by paying, you agree to their terms. Subscriptions renew automatically until canceled; you may cancel at any time, effective at the end of the current cycle. Refunds follow the community's policy and applicable consumer-protection law (in Brazil, the 7-day right of withdrawal for online purchases). Cool may retain service fees as disclosed at the time of purchase.

Acceptable use

You agree not to use Cool for illegal activities, fraud, spam, spreading malware, infringing third-party rights, harassment or any conduct that violates the Code of Conduct. Do not attempt to bypass security, billing or moderation mechanisms. Misuse may lead to suspension or ban (see the Moderation Policy).

Intellectual property

The content you create (posts, courses, materials) remains yours. By publishing it, you grant Cool a limited, non-exclusive license to host, display and distribute that content within the platform as needed to operate the service. Cool's brand, software, design and technology are owned by Cool and may not be copied or reused without authorization.

Liability for third-party content

Cool is an internet application provider and acts as a TECHNICAL INTERMEDIARY: it hosts and distributes content created by community owners and members, but does NOT create, edit, endorse or pre-screen that content. Responsibility for any content, product, service, promise, offer, advice or information published or sold within a community lies SOLELY with whoever published or sold it (the community owner or the member), not with Cool. Cool does not warrant the truthfulness, legality, quality, safety or suitability of third-party content, nor any results they promise. We keep reporting and moderation channels; upon becoming aware of unlawful content or content that violates these Terms — through a party's notice, an internal report or a court order, as required by applicable law — we may remove the content and/or suspend the responsible party, without this constituting assumption of liability for the removed content. Reports can be made through the platform's moderation channels or the email at the end of this document.

Indemnification

You agree to defend, indemnify and hold harmless Cool, its partners, officers, staff and affiliates from any claims, actions, losses, damages, fines, costs or expenses (including reasonable attorneys' fees) arising from: (a) content you published or products/services you offered, sold or delivered through the platform; (b) breach of these Terms, the Code of Conduct or any law; (c) infringement of third-party rights, including intellectual property, image, honor, privacy, data protection and consumer relations; (d) taxes, invoices and legal obligations relating to your sales. This obligation survives the termination of your account.

Acceptance and consent record

By creating a community, purchasing, subscribing or joining a community, you declare that you have read and expressly accepted these Terms, the Code of Conduct and the other applicable policies. For evidentiary purposes, Cool records the date and time, the version of the accepted document and technical information about the acceptance (such as your account identifier). Acceptance is a condition to complete the purchase or the join.

Disclaimers and limitation of liability

The service is provided "as is", without warranties of uninterrupted availability or freedom from errors. Cool is not a party to the relationship between community owners and members and does not guarantee the results of content sold by third parties. To the maximum extent permitted by law, Cool's liability for indirect damages is limited. Nothing in these Terms waives rights that the law grants to consumers on a non-waivable basis.

Suspension and termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms, the Code of Conduct or the law, following the moderation ladder where possible. After termination, we handle your data in accordance with the Privacy Policy.

Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the consumer's domicile are chosen to settle disputes, where applicable, without prejudice to consumer-protection rules.

Changes and contact

We may update these Terms; relevant changes will be communicated on the platform. Continued use after a change means acceptance. Questions: privacidade@cool.app.
