Creator Terms

These are the rules between you, a community creator, and Cool. By creating a community or selling through it, you accept this document. It supplements the Terms of Service — where there is a conflict about your selling activity, this document prevails.

This text is a standard template provided by the Cool platform to help communities and creators get started. It reflects the spirit of Brazil's LGPD (Law No. 13,709/2018) and the GDPR (EU Regulation 2016/679), but it does NOT constitute legal advice. Before publishing, review it with a qualified lawyer to tailor it to your business, country and way of operating.

You are the seller, not Cool

Cool is the platform that hosts your community and intermediates payment collection. The product, the content, any result promises and buyer support are YOURS. You are the supplier before the consumer, including under Brazil's Consumer Protection Code.\nThis means complaints about what was delivered, refund requests outside the legal window and disputes over quality are handled by you. Cool may intermediate, but is not liable for the content you sell.

Platform fee

Cool retains a fee on each sale, shown in your dashboard and at the time you subscribe to a plan. The fee varies by plan and is deducted automatically from the gross amount, before payout.\nThe fee never exceeds the sale amount. Fee changes are communicated in advance and apply to future sales only — never retroactively.

When funds become available

The release window for withdrawal starts when the payment is approved and depends on the method the buyer used:\n• Pix and bank slip: 2 days\n• Credit card: 30 days (this is when the card network settles the funds; it is not a Cool holdback)\nOnce released, a Pix withdrawal usually reaches your account within minutes, on business days and within banking system hours. Delays may occur when the receiving bank or the payment system is unavailable.\nCool may hold funds longer, or require additional verification, when there is concrete evidence of fraud, an atypical volume of disputes, or a legal order. In such cases you are notified with the reason.

Refunds, chargebacks and negative balance

Refunds and chargebacks are debited from you, not from Cool. The amount returned to the buyer comes out of your balance, together with any commissions already attributed to that sale.\nBecause the release window may be shorter than the buyer's withdrawal-right window, a refund may arrive AFTER the funds have been withdrawn. In that case your balance goes NEGATIVE and is offset automatically against subsequent sales.\nIf the negative balance persists and you make no further sales, Cool may charge the amount directly, suspend new withdrawals and, as a last resort, close the account. You agree to keep valid contact details for this scenario.

Taxes and invoices

Taxes on your revenue are your responsibility, as is issuing an invoice to the buyer when required by the laws of your country and your tax regime.\nCool issues a tax document only for its own service fee charged to you, and can provide sales reports to support your accounting.

What you may not sell or promise

You may not use Cool to sell or advertise: illegal or counterfeit products; third-party content without authorization; sexual material involving minors or non-consenting people; promises of cure, medical treatment or guaranteed financial results; pyramid schemes, recruitment-based MLM and chain letters; and any practice prohibited by law.\nEarnings claims must be realistic and accompanied by the necessary context. Customer testimonials must be truthful and representative — fabricating results is deceptive advertising and the liability is yours.

Your members' data

The data of people who join your community is processed by you for your community's purpose, and by Cool to operate the platform. You undertake to use it only for that purpose, to honour unsubscribe and deletion requests, and not to sell or transfer that data to third parties.\nEmail and WhatsApp campaigns must respect the unsubscribes and consents recorded on the platform. Continuing to contact someone who opted out violates these terms and may lead to sending being suspended.

Suspension and termination

Cool may suspend sales, withdrawals or the entire account in case of breach of these terms, concrete evidence of fraud, abnormal volume of refunds and chargebacks, or an order from a competent authority. Whenever possible we notify you beforehand and state what must be corrected.\nYou may close your account at any time. Closing does not cancel pending obligations: negative balance, open refunds and commitments to members who paid for access remain valid. Members with a paid period in progress keep access until the end of the cycle.
